Do you think I can break my lease over my personal security?
I had to sign a 13 month lease and it's $1000 fee to break it.
My car gets broken into over and over and a few weeks ago my hubcaps were stolen. These apartments are awful. I have a really nice place to move to. I want to leave, it's really dangerous here. They tried to fix it by making it a gated community (big deal, everyone jumps the fence) and gave us thumb locks for our windows. I'm afraid to go outside at night. Do you think I have a legal right to break my lease?
Hi, Let me try to help as I am an attorney. (a) For starters; It's best to have a look at your lease and see if there is anything else you need to take care of in addition to the $1000 fee (penalty) to break the lease. (b) Next, try and see if you can find a "replacement" tenant to come forward; this may give you some leverage in negotiating with the landlord, to either lessen if not waive the $1000 penalty altogether. (c) If the house, grounds, gate does not give you sufficient protection, as a negotiating tip, you may want to tell your landlord that he/she owes you a "duty of care" to see that you are "reasonably safe" at all times, whilst you are on the premises, and this should be linked to the fact that you have a legal right to have "quiet enjoyment" of the property. If you can't even feel safe, how can you even have "quiet enjoyment". Use this point also to either lessen or get the $1000 penalty waived. I hope these pointers help. Cheers,
